General Terms of Service ᡣ • . • 𐭩 ♡By commissioning artwork from me, you agree to all terms outlined below. Please review this document thoroughly before placing an order.Turnaround & Working ConditionsThe standard turnaround time for commissions is 2–4 months. However, this timeframe is not guaranteed due to my current circumstances.I am presently without stable housing and have limited access to storage for my iPad, which is also subject to technical issues. Consequently, there may be occasions where I must merge layers prematurely, and I may be unable to record speedpaints consistently.If a speedpaint is required, it must be requested prior to the commencement of the commission, as it cannot be guaranteed once work has started.Delays may occur unexpectedly due to these factors. Clients are expected to communicate promptly throughout the process. Any deadlines or time-sensitive requests must be agreed upon before work begins. Rushed commissions may incur an additional fee and may not always be feasible.Refund PolicyRefunds are very limited. A refund will only be issued if:
• I am entirely unable to complete the commission
• Funds are available at the time of the requestDue to financial constraints, refunds cannot be guaranteed under any other circumstances. By commissioning me, you acknowledge and accept this policy.Revisions & WorkflowDuring the sketch phase, clients are entitled to up to three free revisions, covering adjustments to pose, anatomy, or design.Once the sketch is approved and work proceeds, additional revisions will incur a fee. After layers are merged, changes cannot be undone. Clear and detailed feedback during the sketch phase is strongly encouraged to avoid additional charges.Content Restrictions & ComplexityI do not accept commissions involving:
• Extremely complex or heavy mecha designs
• Hateful, abusive, or otherwise inappropriate contentHighly detailed or intricate designs may require an additional complexity fee to account for the additional time and effort involved.Specific canvas sizes or formatting requests must be provided before work begins.All completed artwork will include a small watermark, which may not be removed. Finished pieces may be displayed publicly in my portfolio or on social media unless an NDA fee is arranged.Usage Rights & OwnershipArtwork may not be used for:
• NFTs
• AI training
• Blockchain projects
• Any similar or related technologiesClients receive ownership of commissioned designs for personal and commercial use, provided proper credit is given to me as the artist.Designs may not be sold, traded, or resold for more or less than their original price unless additional paid artwork has been incorporated. Minor edits are permitted, but major redesigns must remain clearly recognizable as the original design.I do not support Toyhou.se. Clients are responsible for uploading designs there, crediting me properly, and managing their pages independently.Requests for alternate outfits, expressions, backgrounds, or other variations will require an additional fee, depending on the scope of work.Client Conduct & EnforcementHarassment, undue pressure, or attempts to coerce a refund will not be tolerated.I reserve the right to block, refuse service, or cease communication with any client who engages in inappropriate behavior. Violating these terms may result in blacklisting and/or revocation of usage rights without refund.Design-Specific Terms of ServiceWhen ordering custom designs, adopts, or similar works, the following rules apply:• Clients may request specific traits, colors, or design elements, but these must be clearly described before work begins.
• Requests that conflict with my closed species, pre-existing designs, or restricted traits will not be accepted unless prior permission is granted.
• Highly detailed or labor-intensive designs may incur additional fees, depending on complexity.
• Minor changes to traits, colors, or patterns are allowed after the sketch phase, but major redesigns require additional payment.
• All designs remain my intellectual property until fully paid for. Usage rights are granted per the standard ownership rules, and reselling or transferring designs without consent is prohibited.
• Clients are responsible for understanding the pricing, limitations, and rules for the specific design type they are commissioning. Questions should be addressed before placing an order.
• Harassment, pressuring, or attempting to bypass these rules may result in loss of the commission, revocation of usage rights, or blacklisting.Art Trade TermsArt trades are considered secondary to commissions. This means:
• The turnaround for trades may be longer than the standard 2–4 month timeframe for commissions.
• Trades are not prioritized, and clients should not expect expedited completion.
• You may not rush me for any reason; pressuring me can result in me discontinuing the trade.
• My artwork will not be shown publicly or shared until my side is fully completed and your side has been delivered in a verifiable form, such as a large, filtered, or watermarked version.These rules ensure fairness and respect for both participants and protect the integrity of the trade process.BlacklistUnder no circumstances may my artwork, designs, or commissions be sold, transferred, or otherwise provided to the following users, as they are permanently blacklisted:• peachiipop / qeachiiqoq – very rude behavior, childish behavior, harassment and attacking, scamming over $600 from multiple users, failing to complete commissions and/or artwork for months or years after payment, making up excuses, trauma dumping, unprofessional conduct
• ghxztfaze – scamming others with art, failing to complete art, tracing, AI tracing
• .usagiichii. – collaborating with peachiipop, defending prohibited behavior
• thezigzter – rude behavior, personal reasons
• pawzi_pawz – attempting to force a refund, rude behavior
• blu3drag0nzz – forcing refunds
• accalia2004 – personal reasons

• 0strawberrymilk0 – personal reasonsAny attempt to sell or transfer my artwork or designs to these users will be considered a violation of my Terms of Service and may result in legal action, revocation of usage rights, and permanent blacklisting.Legal Notice & EnforcementBy commissioning work from me, you agree that all Terms of Service and Design Rules outlined herein are legally binding under applicable intellectual property and contract laws. Violations of these terms may constitute copyright infringement, fraud, or breach of contract.• Unauthorized use, reproduction, redistribution, or resale of my artwork without permission may result in legal action.
• I reserve the right to document and report violations to relevant platforms or authorities.
• Clients are responsible for adhering to these terms; ignorance or failure to comply does not exempt liability.
